Inka Ayway Peru Travel

These Terms & Conditions govern all bookings and travel services provided by Inka Ayway Peru Travel (“Inka Ayway”, “we”, “us”, “our”). By booking a tour or using our website, you agree to these Terms & Conditions.

1. Company Information

Inka Ayway Peru Travel operates as a tour operator and travel services provider in Peru, offering guided tours, trekking programs, cultural experiences, and custom itineraries.

2. Booking Agreement

• A booking is considered confirmed only after we receive the required deposit or full payment and issue written confirmation.

• The person making the booking accepts these Terms & Conditions on behalf of all travelers in the group.

• Travelers must provide accurate personal information (full name, passport details, date of birth, nationality) as required for permits and reservations.

3. Prices & Inclusions

• All prices are quoted in USD, unless otherwise stated.

• Tour prices include only the services specifically listed in the itinerary.

• Any services not explicitly mentioned are not included.

• Prices may vary due to currency fluctuations, fuel surcharges, taxes, or supplier cost changes prior to confirmation.

Once a booking is confirmed, prices will not change except for government-imposed fees or taxes.

4. Payments

• A deposit of 30–50% is required to secure a booking.

• The remaining balance must be paid 30–45 days before departure, unless otherwise specified.

• Full payment is required for last-minute bookings or for services requiring advance purchase (Inca Trail permits, Machu Picchu tickets, trains, flights).

• Payment processing or bank fees are the responsibility of the traveler.

5. Cancellations & Refunds

All cancellations must be submitted in writing via email. Refunds and cancellation fees are governed by our Booking & Cancellation Policy, which forms an integral part of these Terms & Conditions.

Non-refundable services include (but are not limited to):

• Inca Trail permits

• Machu Picchu entrance tickets

• Train and flight tickets

• Special hotel bookings

6. Changes & Modifications

• Changes to confirmed bookings are subject to availability and supplier policies.

• Name changes or date changes may incur additional fees.

• No guarantees are made that modifications can be accommodated, especially within 30 days of departure.

7. Traveler Responsibilities

Travelers are responsible for:

• Holding a valid passport and required visas

• Meeting physical fitness and health requirements for chosen tours

• Complying with local laws, customs, and guide instructions

• Arriving on time for all scheduled activities

Inka Ayway reserves the right to remove any traveler from a tour if their behavior compromises safety or the experience of others. No refunds will be issued in such cases.

8. Health, Safety & Medical Conditions

• Travelers must inform Inka Ayway of any medical conditions, allergies, or physical limitations prior to travel.

• Some tours involve high altitude, physical exertion, and remote locations.

• Inka Ayway is not responsible for illness, injury, or medical emergencies arising during the trip.

9. Travel Insurance

Travel insurance is strongly recommended for all travelers and should include:

• Trip cancellation and interruption

• Medical expenses

• Emergency evacuation

• Personal liability

Inka Ayway is not responsible for costs that could have been covered by travel insurance.

10. Assumption of Risk

Travel in Peru involves inherent risks, including but not limited to:

• High altitude

• Weather conditions

• Terrain and transportation risks

By participating in a tour, travelers acknowledge and accept these risks and agree to travel at their own responsibility.

11. Force Majeure

Inka Ayway shall not be liable for failure to perform obligations due to circumstances beyond our control, including:

• Natural disasters

• Political unrest

• Strikes

• Government restrictions

• Pandemics or public health emergencies

In such cases, alternative arrangements or credits may be offered where possible, but refunds are not guaranteed.

12. Liability Disclaimer

Inka Ayway acts as an intermediary between travelers and third-party service providers (hotels, airlines, transport companies). We are not responsible for:

• Acts or omissions of third-party providers

• Delays, cancellations, or changes made by suppliers

• Loss, damage, or theft of personal belongings

Our liability is limited to the amount paid for the tour.

13. Photography & Media

Inka Ayway may take photographs or videos during tours for promotional purposes. By participating, travelers grant permission for the use of such media unless a written objection is submitted prior to departure.

14. Website Use & Intellectual Property

All content on inkaayway.com, including text, images, logos, and branding, is the property of Inka Ayway and may not be used or reproduced without written permission.

15. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of Peru. Any disputes shall be resolved under Peruvian jurisdiction.

16. Acceptance of Terms

By booking a tour or using our website, you confirm that you have read, understood, and agreed to these Terms & Conditions.
